2. it's my understanding the original POU/POE ordinance proposed/adopted in 2019 time frame allowed for new construction or an ADU for failed water quality on a shared well system -- as they would deal with it like all other existing connections have to. T/F
3. It's my understanding a lawsuit was filed to block that 2019 ordinance because the filer felt no new construction or ADU permits should be issued if the well water test came back with any water quality failures.
4. It's my understanding the County settled that lawsuit with the filer by agreeing to modify the ordinance per their desire to deny permits on water test fails, and the 2023 ordinance was then implemented with this requirement to deny based on water quality T / F
5. It is my understanding that Glenn Church was a driving person behind that lawsuit (per his own admission in email) and he was one of 5 supervisors on the Board in 2023 when the modified ordinance was adopted T/F
Please state what date the new Hex Chrome 6 state water quality policy went into effect
Please state what date that Monterey County finally passed the ADU Coastal Zone ordinance

I have cc'd everyone on here that should be required to answers these questions quickly, as well as the HCD Executives who oversee permitting who would be the ones caught in a bind if a permit was denied by EHB, given they are the front facing people for permitting (with EHB behind them enforcing a POU/POE ordinance passed by the Board that had been modified because of a lawsuit ( with Church's interest or backing) )

If the water quality test shows a fail for Nitrates (based on mcl reqs for public water systems), the permit would be denied. The only remedy would be a new test that showed nitrates below mcls for public water systems. T / F (this should have been grouped with questions 4 and 5, same concept)
Because we currently have 9 connections and water systems shift from private to public systems when more than 14 connections exist - if 6 people on my system wanted to build ADUs to lessen housing, our system would shift into a different class of regulations -- it would be recategorized as a public water system -- potable drinking water standards would be enforceable via penalties and fines. (ie all drops coming from the system would be expected to be drinkable at all times -- even though only 7 of every 1000 could reasonably be expected to be consumed for a standard household) T / F
The new POU/POE ordinance includes a "requirement" for water systems to apply for grants for water purification systems if such grants are made available for 1) contaminated systems and/or 2) any small water systems Please confirm or clarify this.

A person on our Water System has recently notified me they were planning on selling their home and asked for relevant documents for disclosures. Their agent has also just contacted me.

As a community of tax payers who need to make proper disclosures to protect ourselves from legal liabilities from prospective home buyers, we now need these questions answered.

Demands

Please provide a response to the questions on District 2 letter head. It may be a cover letter for a document or documents drafted by others.
Please provide evidence that all parties cc’d on those emails have been provided a copy of the information you response with and they are either in agreement with it or oppose it in some way
Please provide an explanation for why those emails were not responded to in a timely manner - and thus, why a formal demand and certified mailers, at my expense were required for basic clarity on foundational ADU permit feasibility questions that all property owners on wells might face.
Please coordinate a reimbursement process for the certified mailer expense I incurred to ensure this notice was delivered as required to be deemed “actual notice” for legal purposes.

Your office has until Friday July 31, 2026 to satisfy this demand.
